Terms & Conditions

  • Residential Use Only: The allotted housing shall be used strictly for residential purposes. No structural modifications or unauthorized/commercial use shall be permitted by the allottee. In case of any violation, the developer/firm (Nital Infra Projects LLP) reserves the right to issue notice and cancel the allotment after providing an opportunity for a hearing.

  • Lottery Participation: Applicants submitting applications within the specified time will be included in the lottery based on priority. A list of successful applicants will be released by the developer/firm.

  • Change of Address: Applicants must inform the developer/firm in writing about any change of correspondence address. If the address is not updated or incorrect, the developer/firm will not be responsible for any failed communication. Applicants must mention their priority/form number and attach self-attested copies of required documents while requesting an address change. The new address will be valid only after confirmation by the developer/firm.

  • Restricted Address Use: If an applicant provides an address restricted for general access, they must stay in contact with the developer’s office for communication and any delays in correspondence will be their responsibility.

  • Eligibility Criteria for Allotment: Only one person from the family (husband, wife, or dependent) can apply for allotment based on income group.

  • Delay in Taking Possession: Once construction is complete and the possession notice is issued, delay in taking possession will incur maintenance charges payable by the allottee.

  • Regulations & Changes: Allotment shall be subject to the rules/orders/circulars issued by the State Government. The developer/firm reserves full rights to amend allotment rules in accordance with such directives, and the changes will be binding on all registered applicants/allottees.

  • Payment Methods: Application fees will only be accepted through online transfer, cheque, or demand draft. Cash transactions will not be accepted. No individual or representative other than the developer/firm (Nital Infra Projects LLP) is authorized to accept payments beyond the declared sale price.

  • Occupancy Requirement: The allotted flat must be occupied within one year of possession.

  • Non-Changeable Allotments: Flats allotted through lottery cannot be changed.

  • Applicability of State Amendments: Any amendments made by the State Government in the Affordable Housing Scheme will be applicable.

  • Common Areas & Maintenance: All allottees must become members of a registered society/company responsible for maintenance of shared areas and services (stairs, lifts, gardens, parking, community buildings, water, electricity, sewerage, etc.). A pre-determined amount must be deposited before possession, which will be transferred to the society’s bank account. Future maintenance charges shall be paid by the allottee. Possession will be granted only upon submission of a maintenance undertaking.

  • Refund for Unsuccessful Applicants: Based on the number of applications, lottery will be conducted for available flats by income group and preference. Unsuccessful applicants will receive refunds (without interest) via crossed cheque sent by registered post to the address mentioned in the application.

  • Statutory Dues Post Possession: From the date of possession notice, the allottee must bear all statutory taxes and dues payable to Central, State Government, or legal entities (e.g., property tax, municipal tax, urban records, etc.).

  • Fittings After Possession: To prevent damage or theft, the following fittings shall be completed within one month after the actual date of possession: electrical fittings/fixtures, sanitary fittings.

  • Design & Specification Rights: The developer/firm reserves full rights to make changes in the proposed design/specification/size.

  • Delay Due to Force Majeure: The developer/firm shall not be liable for any delays caused by daily events/natural disasters/court orders/unavailability of construction materials.

  • Commitments by Brokers/Representatives: Any promise or commitment made by brokers/sales representatives not included in the application form will not be valid.

  • Policy/Act Changes: The developer shall not be responsible for any future policy, act, or rule changes made by the Government of India or Government of Rajasthan.

  • Legal Heirs & Representatives: The legal heirs/nominees or legal representatives of the applicant will be bound by the terms mentioned in the application form.

  • Pre-Application Awareness: Full information about the project and applicable rules will be provided to the applicant before applying. Complaints from successful applicants after the lottery will not be entertained.

Application Eligibility:

  • The applicant must be at least 18 years old on the date of application.

  • Applications submitted in the name of institutions/companies will not be accepted.

  • The applicant must be a permanent resident of Rajasthan or residing in the state for at least the past one year.

  • Non-residents who have been living in Rajasthan for over a year may also apply, but preference will be given to permanent residents.

  • Applicants must submit income certificates and affidavits attested by a notary.

  • Salaried applicants must provide employer-certified income proof; self-employed applicants must provide income proof from a Tehsildar/Municipal Officer/SDO or a self-attested affidavit authorized by the state government.

  • Applicants must attach a self-attested copy of address proof with the form (e.g., PAN card, Aadhaar card, Bhamashah card, Voter ID, Passport, Driving License, Ration Card, Electricity/Water/Telephone bill, Bank passbook, or any other valid photo ID).

  • All correspondence will be done using the address provided in the application form.

  • Any overwriting, erasing, or alteration in the application form is prohibited. Applicants must exercise full caution while filling the form.

  • Group (bulk) bookings may be considered based on availability.

  • Priority will be given to physically disabled and senior applicants for ground and first-floor allotments.

Refund Provisions:

  • If an applicant applies in writing with valid reasons for refund before the priority lottery, the full application amount will be refunded without interest.

  • If the refund request is made after the priority lottery, the application amount will be refunded after deduction of administrative charges, without interest.

  • If the application is rejected due to deficiencies, the deposited amount will be refunded via crossed cheque sent by registered post to the address mentioned in the application. No interest will be paid by the developer/firm during this period.

  • If the allottee fails to deposit the amount stated in the demand letter within three months, interest at 18% per annum shall be applicable. Delay beyond three months will result in automatic cancellation of the reservation.

  • If the proposed scheme is not realized due to unavoidable reasons, the application amount shall be refunded with 9% annual interest.

  • In the case of joint applicants, if any one of them chooses not to proceed with the flat, the developer/firm will cancel the application and refund the amount to the address provided by the primary applicant.
